Law of Property Act Receivership (LPA Receivers)

UtilitiesWestbrookes Corporate also act for clients as a receiver (LPA Recievers) instructed by deed of appointment under the Law Of Property Act 1925.

An LPA Receiver is appointed by a lender who has a fixed charge over the property under the statutory power given in section 109 Law of Property Act 1925.

The powers of the LPA Receiver are as follows:
  • To demand and recover rent to give receipts for income.
  • To insure any property against loss or damage.
  • To grant a lease over the property at the best reasonably obtained rent.
  • To accept a surrender of a lease in order to grant a new lease.
  • Obtaining possession if it is occupied illegally or the occupier has defaulted on his obligations, for example to pay rent
  • seeking planning consent or otherwise dealing with the property
  • paying monies collected to repay the loan due
  • agreeing a settlement with creditors if needs be
  • paying to the owner/borrower any money that is left over after repaying all the debts and costs
In a well drafted mortgage the above powers of an LPA Receiver are extended and would allow the LPA Receiver to take control of the property and act as he considers fit with the consent of the mortgagee.

What happens in LPA Receivership

The purpose and requirement of the LPA Receiver is to manage the recovery of the outstanding arrears/debt owed to the property's lender. This would involve taking over the control of the property therefore taking the position of the owner. The next job is to focus on the task to arrange an early sale of the property so that the sale funds can repay as much of the loan as possible. On all cicumstances each situation is reviewed and the property is rated in a report as to how appropriate it is to be entered in Receivership. This does flag up problems that clients/lenders may not be aware of which could dramatically change how the property can be dealt with. Details of all tenants and occupancy is investigated and owners are requested to forward information regarding their tenants to the LPA Receiver should tenants be in situ. Full details of planning permissions are sought from the the local planning offices and if necessary other licenses are taken into account to confirm any problems that all parties should be aware of. After the validity opf appointment, the LPA Receiver takes control of the property and the owner cannot have any dealings with the property in any manner. The LPA Receiver decisions in dealing with the matters on the property gives them full discretion.

Why instruct a LPA Receiver

Mortgage Lenders can be hit with a variety of problems on different circumstances in which it is not possible for them to have the correct advice and skills to deal efficiently with the properties that they wish to enter into LPA Receivership. They also do not wish to have direct dealings on all occasions with the borrowers and by placing a property into LPA Receivership givens a middle-man who is skilled in the marketing, sales and management of property. LPA Receivers are industry skilled people who are defined as expertswho have the capablity of managing property whilst being able through local knowledge and understanding to attain the best prices and advice for their clients. The LPA Receives deal directly with the occupants of the property, manage outstanding problems, deal with insurance and any repairs that are needed on the property manage throught their nationwide maintenance on-going contracts. The LPA Receivers are responsible for dealing direct with the tenants so that the rent can be collected in order to repay back the outstanding debt.
